Judicial Ethics

Professor Ross has served as an expert witness on judicial ethics in the following cases:

Naef v. Masonite Corp, et al. (Circuit Court of Mobile County, Alabama), 681 So.2d 1068 (Ala. 1996); expert witness for defendant in support of defendant’s motion for judicial disqualification, 1996.

JB & Le Venture v. Mutual Life Insurance Co. of New York (U.S. District Court for the Eastern District of California, Case No. CIV-S-93-1687-LKK); expert witness in support of judicial disqualification motion, 1998.

Afremov v. Amplatz, et. al (District Court, Fourth Judicial District, Case No. 02-17734; expert witness for defendants regarding motion for disqualification of judge, 2003.

United States v. Razmilovic, et al., Case No. 2:04-cr-519-LDW-2 (U.S. District Court for the Eastern District of New York); expert witness for defendants on judicial disqualification motion, 2005.

Professor Ross also has served as a consultant on judicial discipline cases pending before judicial discipline commissions in Florida and Washington state.

Ethics of Attorney Billing and Fees

Professor Ross has served as a consultant on attorney billing ethics in a substantial number of cases in which he has reviewed attorney bills and offered opinions concerning the extent to which such bills conformed to ethical standards as described in codes of ethics and judicial decisions. He has been certified as an expert witness in the following cases involving fee disputes:

The Sporicidin Company v. Hauser, et al. (Superior Court of the District of Columbia, Case No. 96ca0044347); expert witness for plaintiff on billing ethics, 1996-98; testified in court in March 1998. Plaintiff’s counsel: John W. Toothman, P.C., Suite 450, 300 North Lee Street, Alexandria, Virginia.

Hays, et al. v. State of Louisiana, et al. (U.S. District Court for the Western District of Louisiana, Civ. Action No. 92-1522); expert witness for defendant on issues involving fee petition submitted by plaintiffs’ attorneys, 1998.

Traven v. Allstate Insurance Co. (Circuit Court, Brevard County, Florida); expert witness for defendant in billing dispute; testified at hearing in 1999.

Cacheaux, Cavazos, Newton, Martin & Cuk v. Rexhall Industries, Inc. (District Court of Bexar County, Texas, Cause No. 2000-CI-08064); expert witness for defendant regarding fee petition submitted by plaintiffs’ attorneys, 2000.

Haus, Roman and Banks LLP v. Bonnie Schoeneman (Circuit Court of Dane County, Wisconsin, 02CV0465); expert witness for defendant regarding ethics of attorney fees, 2002.

Professor Ross is the author of two books concerning legal fees, The Honest Hour: The Ethics of Time-Based Billing by Attorneys (Carolina Academic Press, 1996) and Legal Fees: Law and Practice (with John W. Toothman, Carolina Academic Press, 2003). In addition to writing and lecturing about legal fees, Professor Ross has taught this subject as part of professional responsibility courses that he has offered at the law schools of Samford, Notre Dame, and Florida State.

Ethics of Attorney Disqualification

Professor Ross has served as a consultant several times on attorney disqualification issues. He testified in court in January 2002 as an expert witness the ethics of ex parte communications in Reynolds v. Alabama Department of Transportation, et al., (U.S. District Court for the Middle District of Alabama, CV 85 T 665 N).
